Introduction
This route allows a parent to apply for leave to remain in the UK based on having sole responsibility for a British child, or a child who has lived in the UK for a continuous period of at least 7 years.
Eligibility requirements typically include:
The child is under 18 and is British or has lived in the UK for at least 7 years
- You have sole responsibility for the child’s upbringing, or there are serious and compelling reasons for the child to remain with you
- Evidence of active involvement in the child’s life, including key decisions relating to their welfare, education, and health
- The child normally lives with you, and you play the primary caregiving role
- You meet suitability requirements (including immigration history and character)
Important information
“Sole responsibility” is a complex legal test and requires detailed, high-quality evidence. The Home Office will assess who makes the important decisions in the child’s life, not just who the child lives with. In some cases, alternative arguments based on the child’s best interests may be relevant.
